Can an NRI Rent Out Property in India? FEMA Rules, NRO Account and Tax

The short answer is yes. An NRI who owns a flat in India can let it out, collect rent and keep the property. What changes is the plumbing around the rent: where it is usually received, how it is taxed at the source, and how much you can send abroad. Here is the full picture.

What the rules allow

Under FEMA, NRIs and OCIs can hold residential and commercial property in India and receive the rent from it. The RBI's FAQ says NRIs and PIOs can rent out their property in India without the Reserve Bank's permission, and that rental income is a current-account transaction that is freely repatriable. What the rules do control is how the rent is taxed and documented before it leaves India. Rent is normally credited to an NRO account; RBI rules also allow it to be credited to an NRE account once tax has been deducted or paid, if your bank agrees.

The tax in one paragraph

Rent is taxable in India for an NRI. The tenant deducts about 31.2% under Section 393(2) of the Income-tax Act 2025 from every payment; you then file a return to settle the actual tax and claim the refund, or apply for a lower deduction certificate in advance (how). Your country of residence may also tax the same income, with relief for the Indian tax (the DTAA guide shows how).

Getting the money out

After tax is settled, rent can be sent abroad with a remitter's declaration and, where needed, a CA's certificate: see the Form 145 and 146 guide.

What NRIs cannot do

NRIs generally cannot buy agricultural land, plantation property or a farmhouse. If you inherited such property, the rules on holding and transferring it differ; ask a lawyer before you act. Letting out the ordinary residential flat or shop you hold is the normal case this page covers.

Running it from abroad day to day

The recurring work is rent follow-up, tenant paperwork, maintenance, property tax and the annual return. The complete NRI guide sets out how owners handle it remotely, and the country guides cover the logistics for the US, UK, UAE, Canada, Australia and Singapore.

Where Rent Connect fits

Most of this is admin that someone has to remember every month. Rent Connect is a property management tool for owners who rent out property in India, currently in early access. It sends WhatsApp rent reminders, records each payment as pending, overdue or paid, and generates a rent receipt when a payment is marked paid. Tenant details, the agreement and maintenance issues (with photos) sit on one tenancy record, and a Deposit Ledger records the agreed deposit and any move-out deductions. The ledger is a shared record only: Rent Connect does not hold the money.

It does not file police intimations, compute or deposit TDS, or file tax returns for you. Those stay with you, your tenant and your CA. To follow the launch, join the waitlist.

How this page was checked

Figures here were compiled on 16 October 2026 from the sources below. Where we could not open an official page, the note at the end says so. Government portals and rates change, so confirm the live number or form with the office before you pay or file.

What we could not verify: We did not read the current FEMA regulations or RBI master direction on immovable property, only bank and advisory summaries and an older RBI document. The statement that no prior RBI approval is needed to let out property comes from the RBI FAQ as reported in search results; we did not read the live FAQ page.

Frequently asked questions

Can an NRI rent out a flat in India?

Yes. FEMA lets NRIs and OCIs hold and let out residential and commercial property in India. Rent is normally paid into an NRO account and is taxed at source.

Do I need RBI permission to rent out my property?

No. The RBI says NRIs and PIOs can rent out their immovable property in India without seeking its permission (RBI FAQ, as reported). Confirm with your bank for your case.

Where is the rent credited?

Usually to an NRO account in rupees. RBI rules also let banks credit current income such as rent to an NRE account if they are satisfied that it is current income and that tax has been deducted or paid. Confirm with your bank.

How much tax is deducted on rent paid to an NRI?

About 31.2% (30% plus 4% cess), deducted by the tenant on every payment; the final liability is settled when you file your return.

Can I send the rent abroad?

Yes. Rent is current income and can be sent abroad once tax is settled, with the required declaration and, where needed, a CA's certificate. The USD 1 million per financial year limit applies to other NRO balances, such as sale proceeds, not to current income.
