Rent Agreement in Chennai: Stamp Duty, Registration & the Tamil Nadu Tenancy Act

In Chennai a state tenancy law shapes the agreement: Tamil Nadu's 2017 tenancy law requires a written agreement and brings in a Rent Authority. Guides disagree on the details of stamping. This page separates what is consistent from what is not, and gives a worked stamp-duty example.

The Tamil Nadu law you need to know

The Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 says premises may be let only under a written agreement (Section 4(1)). Every such agreement must be registered with the Rent Authority by the owner or tenant within the time set by the rules (Section 4(3)), and the Rent Authority issues a registration number within 30 days (Section 4(4)). This applies whatever the term and is separate from registration at a sub-registrar. Applications are reported to be filed online at tenancy.tn.gov.in; check the rules for the current deadline (statute text as reproduced online; we did not read the gazette).

Stamp duty: what is reported

SourceReported duty on a residential lease
One guide1% of rent plus deposit, regardless of duration
Another1% of rent plus deposit, applying for a period of up to 30 years
A thirdFor up to 11 months, 1% of annual rent plus deposit (minimum about ₹50), with no registration fee; for 12 months or more, 1% of the total, with a registration fee of about ₹1,000

The property-purchase rates (7% stamp duty, 4% registration) that dominate Chennai search results do not apply to a rent agreement.

A worked example

A flat in Velachery at ₹28,000 a month with a ₹84,000 deposit (three months' rent) on an 11-month agreement. Rent for the term is ₹3,08,000; adding the deposit gives ₹3,92,000, and at the reported 1% the duty is about ₹3,920. If the third source is right and the base is annual rent (₹3,36,000) plus deposit, the base is ₹4,20,000 and the duty about ₹4,200. Either way the figure is about ₹4,000; confirm with the registration department.

Chennai practicalities

  • E-stamp or stamp paper. One guide says you can print the agreement on e-stamp paper in Chennai; check which your sub-registrar accepts.
  • Associations. Many resident associations ask for the signed agreement and the police acknowledgement before issuing access.
  • Police intimation separately. Register the tenant: Chennai tenant registration.
  • Deposit. Section 11 of the 2017 Act makes it unlawful to take a deposit of more than three months' rent unless the agreement says otherwise. If you take more, record it expressly in the agreement. See security deposit rules.

If you live abroad

Many Chennai owners live overseas. The online parts (stamp, drafting, e-sign if you have an Indian-linked Aadhaar) work from anywhere. Anything that needs presence, such as registration or submission to the Rent Authority, needs a trusted representative; read the PoA guide before you grant authority. Rent received is taxed at source for non-residents: TDS on rent paid to an NRI.

Where Rent Connect fits

The paperwork around a tenancy is easier when it lives in one place. Rent Connect is a property management tool for owners who rent out property in India, currently in early access. It sends WhatsApp rent reminders, records each payment as pending, overdue or paid, and generates a rent receipt when a payment is marked paid. Tenant details, the agreement and maintenance issues (with photos) sit on one tenancy record, and a Deposit Ledger records the agreed deposit and any move-out deductions. The ledger is a shared record only: Rent Connect does not hold the money.

It does not file police intimations, compute or deposit TDS, or file tax returns for you. Those stay with you, your tenant and your CA. To follow the launch, join the waitlist.

How this page was checked

Figures here were compiled on 16 October 2026 from the sources below. Where we could not open an official page, the note at the end says so. Government portals and rates change, so confirm the live number or form with the office before you pay or file.

What we could not verify: The Tamil Nadu registration department and the text of the 2017 Act could not be opened. The Act's sections were read as reproduced on a legal database, not the gazette. The 1% stamp duty, its base, the sub-registrar registration fee and the Rent Authority deadline in the rules are reported inconsistently, so none is stated as settled.

Frequently asked questions

What is the stamp duty on a rent agreement in Chennai?

Guides report about 1% of rent plus deposit; they disagree on whether the base is the rent for the term or annual rent, and on registration fees. Confirm with the Tamil Nadu registration department.

Is a rent agreement registration compulsory in Chennai?

For the Rent Authority, yes. Section 4(3) of the 2017 Act requires every written tenancy agreement to be registered with it, whatever the term. Registration at a sub-registrar is a separate question; verify the current procedure.

What is the Rent Authority?

The body set up under the Tamil Nadu 2017 Act to handle tenancy agreements and disputes between owners and tenants.

Do the 7% and 4% property rates apply?

No. Those are for buying property, not for renting it out.

Can an NRI owner complete this from abroad?

The stamping and drafting can be done online, but registration or Rent Authority steps may need a representative in Chennai.

General information, not legal advice. Confirm duty and procedure with the Tamil Nadu registration department and the Rent Authority, and take a local advocate's advice on the agreement.
