Rent Agreement Stamp Duty in Noida (Uttar Pradesh): The November 2025 Cabinet Decision Explained
In November 2025 the Uttar Pradesh cabinet approved capped stamp duty and registration charges for rent agreements of up to ten years, set by the tenancy period and the average annual rent. We could not find the notified table or its effective date, so ask the sub-registrar which rule applies to your agreement before paying. This page explains the decision as reported and what to check.
What changed
In November 2025 the Uttar Pradesh cabinet was reported to have approved a sharp reduction in stamp duty and registration charges on lease and rental agreements. Instead of a straight percentage, charges are capped by the length of the tenancy and the average annual rent. Reports described reductions of up to about 90% for some cases, and the Retailers Association of India published a summary of the decision.
The bands as reported
| Average annual rent | Reported charges (stamp duty, or stamp duty plus registration, depending on the report) |
|---|---|
| Up to ₹2 lakh | About ₹500 to ₹2,000 |
| ₹2 lakh to ₹6 lakh | About ₹1,500 to ₹7,500 |
| ₹6 lakh to ₹10 lakh | About ₹2,500 to ₹10,000 |
Read this carefully. The ranges above are what two reports (DNA and Outlook Money) listed for the capped structure; the exact notified table and the effective date were not available to us. The range within each band depends on the tenancy period. Older articles that say 2% for leases up to three years, or 4% on lease deeds, describe the position before the change.
A worked example
A flat in Sector 137 at ₹28,000 a month has an average annual rent of ₹3,36,000, which sits in the ₹2 lakh to ₹6 lakh band. On the reported structure the combined stamp and registration charges would fall somewhere between about ₹1,500 and ₹7,500 depending on the term, rather than a percentage of the whole rent. If you are quoted a figure far outside that, ask which rule the agent is using.
Uttar Pradesh's 2021 tenancy law
The Uttar Pradesh Regulation of Urban Premises Tenancy Act, 2021 requires a written tenancy agreement. Summaries of Section 4 say that for residential tenancies of 12 months or more the owner and tenant must inform the Rent Authority within two months, and that shorter residential tenancies are exempt. We read these only in secondary summaries; check the current rules before you sign a multi-year lease.
Registration
The general rule still applies: a lease running beyond 12 months must be registered (Registration Act, 1908, Section 17). The reduced charges make registration more attractive for longer tenancies in Noida, for example a multi-year corporate lease. Check the Uttar Pradesh registration department's portal for how to file.
Greater Noida West and new-tower owners
Many Noida owners let out under-construction flats they bought as investments and took possession of recently. If you are a first-time owner, put the possession date, the maintenance dues to the builder or association, and who pays them into the agreement. Our Noida property management guide covers the market. Do not forget tenant registration with police: Noida tenant registration.
If you live abroad
The e-stamp and filing steps are online; signing is the obstacle for owners abroad. Courier or electronic signature works for the 11-month form; a registered lease needs attendance or an authorised representative. Remember TDS if you are a non-resident: TDS on rent paid to an NRI.
Where Rent Connect fits
The paperwork around a tenancy is easier when it lives in one place. Rent Connect is a property management tool for owners who rent out property in India, currently in early access. It sends WhatsApp rent reminders, records each payment as pending, overdue or paid, and generates a rent receipt when a payment is marked paid. Tenant details, the agreement and maintenance issues (with photos) sit on one tenancy record, and a Deposit Ledger records the agreed deposit and any move-out deductions. The ledger is a shared record only: Rent Connect does not hold the money.
It does not file police intimations, compute or deposit TDS, or file tax returns for you. Those stay with you, your tenant and your CA. To follow the launch, join the waitlist.
How this page was checked
Figures here were compiled on 16 October 2026 from the sources below. Where we could not open an official page, the note at the end says so. Government portals and rates change, so confirm the live number or form with the office before you pay or file.
- Outlook Money, 16 November 2025: Yogi Adityanath approves major relief on tenancy registration fees in Uttar Pradesh
- Retailers Association of India: major relief on stamp duty for lease agreements in UP
- DNA India: state cuts stamp duty, registration fees for 10-year tenancy agreements
What we could not verify: We could not open the notified UP table or confirm the effective date and whether the cut has been fully implemented in Noida. The bands are from two press reports of the cabinet decision and are indicative only.
Frequently asked questions
What is the stamp duty on a rent agreement in Noida?
Uttar Pradesh was reported to have capped lease charges in November 2025 by tenancy period and average annual rent, replacing older percentage rates. Check the notified table at the registration department before paying.
Is the old 2% rate still valid in Uttar Pradesh?
Possibly not. If the November 2025 decision has been notified and applies to your agreement, the older percentage rates (such as about 4% of the lease value) no longer apply. Confirm with the sub-registrar.
Do I need to register an 11-month agreement in Noida?
No. Only leases above one year must be registered, though the lower charges may make registration worth considering for longer tenancies.
Where do I get the exact rate?
From the Uttar Pradesh stamps and registration department or the sub-registrar for Gautam Buddh Nagar.
Do these rules apply to Delhi or Gurgaon?
No. Each state sets its own stamp duty.
General information, not legal advice. Confirm the current charges with the Uttar Pradesh registration department, and take a local advocate's advice on the agreement.
